Give Joe Jackson permission to sue a Las Vegas pharmacy

A judge said on Wednesday that Joe Jackson, Michael’s father, can pursue his lawsuit against a pharmacy in Las Vegas. The pharmacy sold the anesthetic propofol to Dr. Conrad Murray. Murray is accused of causing Michael Jackson’s death by injecting him with this drug. Joe filed his lawsuit against the pharmacy in court on November 30 last year. The lawsuit claims that the pharmacy sent a large amount of propofol to a residential apartment in Santa Monica, even though selling that amount of propofol to non-legal persons is illegal. Federal law prohibits pharmacies from sending drugs such as propofol to places that do not have authorization to use these drugs. Propofol is a hospital anesthetic and is used only in operating rooms with an anesthesiologist present. The pharmacy’s lawyers say they had no responsibility to warn Michael Jackson about the use of this drug, and that Michael’s personal doctor, Conrad Murray, should have done that. In the same lawsuit, 82-year-old Joe also named Murray and sued him for the murder of his son. He had previously filed his lawsuit in federal court on June 25 last year, but the judge asked that the case be referred to state court because it could not be handled in federal court.
