With the conclusion of witness testimony from both sides of the case on Friday, the jury instructions were read out in court today.
The jury members must answer sixteen questions to reach a verdict of "liable" or "not liable" against AEG. If 9 of the 12 jury members unanimously answer "no" to any of the first five questions, deliberations will end and a verdict will be issued. Otherwise, they will continue answering the remaining questions.
The jury's process is as follows:
1: Did AEG Live hire Murray?
If yes, proceed to question 2. If no, do not answer the remaining questions.
2: Was Dr. Murray unfit and incompetent in performing the job for which he was hired?
If yes, proceed to question 3. If no, do not answer the remaining questions.
3: Did AEG Live know, or should it have known, that Murray was unfit and incompetent, and that this unfitness and incompetence created particular dangers for others?
If yes, proceed to question 4. If no, do not answer the remaining questions.
4: Did Murray's unfitness and incompetence cause harm to Michael Jackson and the plaintiff Jacksons?
If yes, proceed to question 5. If no, do not answer the remaining questions.
5: Was AEG Live's negligence in hiring, supervising, and retaining Murray a substantial factor in causing harm to Michael Jackson and the plaintiff Jacksons?
If yes, answer the remaining questions. If no, do not answer the remaining questions.
6–13: If the jury has reached question 6, it means they have found AEG Live responsible for Michael Jackson's death. The next eight questions will determine the amount of economic and non-economic damages suffered by the victim's mother and children.
14–16: When the jury reaches the final three questions, the damages figure may be significantly reduced. In these three sections, members are asked whether Michael Jackson contributed to his own death, and if so, to what extent.
