Court Session 9: Testimony by the Accuser
The start of the ninth court session was delayed by more than an hour due to Michael Jackson being taken to the hospital because of severe back pain. Michael entered the courtroom wearing a white T-shirt, a black blazer, and blue sweatpants, and sat behind the table reserved for the defense team. In court, Michael’s mother and father and his brother Tito were present.
Then, the 15-year-old accuser, using the alias John Doe, described and explained how the alleged acts were carried out by Jackson.
John Doe said that Michael Jackson sexually abused him at least twice. He indicated that the abuse may have happened more times, but he could only remember two times.
He said that during his stay in Neverland, Jackson gave him alcohol and, under the pretext of showing him how to masturbate, sexually abused him. The accuser claimed that Michael Jackson considered the act necessary and natural.
He said that the first time this happened was in February 2003, after the television broadcast of the documentary “Living with Michael Jackson,” while they were in Michael’s bed and had been drinking alcohol.
“Michael talked to me about masturbation. He said that if men don’t do this, their actions might end up leading to them raping a girl. He said that once, from the balcony, he saw a boy who wasn’t doing it sexually with a dog.”
“He put his hand inside my pants and sexually abused me.”
He continued that he felt bad about it, but Jackson told him that it was harmless and natural.
He said that the second time he was abused was one or several days after that incident. They were watching television. But this time, Jackson asked him to do it as well.
“He took my hand to make me do it, but I pulled my hand away. I didn’t want to do it with him.”
The accuser’s testimony on this matter differed from his brother’s statements in previous court sessions. The accuser’s brother had claimed that he witnessed his brother being sexually abused by Jackson twice, but that both times they saw it while they were lying on the bed together. The accuser’s brother said that Michael Jackson had closed his eyes, and his brother was also asleep. It is still unclear whether the two brothers’ different descriptions of how the crimes were carried out relate to the same alleged scenes against Michael Jackson or not.
The accuser also claimed that Michael gave him alcohol in an airplane inside a soda can and asked him not to tell anyone about it. Then he gave him a coat and a watch as a gift and said it was worth $75,000.
John Doe said that in Neverland, Jackson showed him obscene photos, and despite what he told Jackson—that he had lost one kidney and should not drink alcohol—Michael still gave him alcohol.
The accuser claimed that his mother was afraid of two of Jackson’s employees who were pushing them to go to Brazil.
Thomas Mesereau, the defense attorney, accused the accuser of storytelling.
“After you met with a lawyer, you made up a story that Michael Jackson sexually abused you.”
“No, I never told him (that lawyer) anything about it.”
He acknowledged that after meeting with the lawyer, he and his family had visited Neverland several times.
Thomas Mesereau attacked the accuser’s statements claiming that Michael did not help him much when he had cancer.
The accuser had said, “I didn’t see him much. He was my best friend in the world. And when I had cancer, my best friend was trying to stay away from me.”
The prosecution has accused Michael’s family of keeping the accuser’s family in Neverland against their will. When Mesereau asked the accuser whether they had free accommodations in Neverland, he said, “Everyone stays free in Neverland.” Then Mesereau asked:
“Well, who do you think pays the bills?”
At that moment, Judge Melville told the defense attorney and the witness not to argue with each other.
At the end of this session, Mesereau asked the accuser about their lawsuit against the Tower Records store guard, J.C. Penny. [In 2001, the accuser’s family was arrested by the store’s guards while wearing clothes whose payment had not been made. After some time, the accuser’s mother claimed that one of them sexually abused her during the scuffle. The store officials reach an agreement on the amount requested by the mother to protect their reputation, and they persuade her to stop continuing the lawsuit against them.]
Mesereau told the accuser that the 2001 witness statement sheet said that he had been told what to say. The accuser denied the claim.
It is worth noting that while the prosecution asked him questions, the accuser was yawning. Once he said that the only thing he needed was a “pillow,” and then he started laughing.
After the court ended, Brian Oxman told reporters that “Michael Jackson had severe pain and throughout the entire trial he felt discomfort.”
